Unemployment Benefits and Filing

File a Delaware unemployment claim promptly and continue requesting benefits for each eligible week. Delaware generally requires claimants who are not exempt to register with Delaware JobLink within three business days, keep that registration active, and complete an active work search each week. The state currently requires at least one new work-search contact each week.

Layoff-Notice Protections

Delaware does not have a separate state mini-WARN law. Federal WARN may require 60 days of notice for certain large layoffs and plant closings. Delaware’s employment and training system can connect affected workers with reemployment and training services, but it does not determine whether WARN was violated.

Health-Insurance Coverage

Workplace Problems and Legal Help

Delaware’s Office of Labor Law Enforcement handles certain wage-payment, minimum-wage, meal-break, and related labor-law issues. The Office of Anti-Discrimination handles employment-discrimination charges under laws within its authority. Different claims have different deadlines.
